The Company may refuse, suspend, terminate, delete or amend any artwork, materials, information or content of any data or information or posting so as, in the sole opinion of the Company, to comply with the legal or moral obligations as placed on the Company and to avoid infringing a third party's rights or any other rules, standards or codes of practices that may be applicable to the posting on rvaastu.com or the internet. The data fed by the User can be updated by the User alone and is solely their liability so rvaastu.com is not responsible for the updated status of the information.
The User shall ensure that while using the Services, all prevailing and applicable laws, rules and regulations, directly or indirectly for the use of systems, service or equipment shall at all times, be strictly complied with by the User and the Company shall not be liable in any manner whatsoever for default of any nature regarding the same, by the User.
The Site is controlled and operated from India and the Site makes no representation that the materials are appropriate or will be available for use in other parts of the World. If you use this site from outside India, you are entirely responsible for compliance with all applicable local laws as well as international conventions and treats.
Users are strongly advised to independently verify the authenticity of any Pre-Launch offers received by them. The Site does not endorse investment in any projects which have not received official sanction and have not been launched by the Builder/Promoter; Users dealing in such projects shall be doing so entirely at their risk and responsibility.
Users also need to make necessary background checks and verification on any information provided by the users related to the Projects / Properties before making investments.
rvaastu.com assumes no liability for the quality and genuineness of the Projects / Properties displayed but if any complication happen the respective RERA of Projects / Properties is responsible.
RERA DISCLAIMER
The Users who are sellers such as Project Developers / Builders / Real Estate Agents shall obtain necessary registration under the said Act and ensure all necessary compliance with the rules, regulations and guidelines of RERA Act 2016. It is mandatory that these Users disclose all the requisite information and relevant details as prescribed in the RERA Act 2016. rvaastu (Ravindra Rasal )neither guarantees nor offers any warranty about the information including RERA credentials posted by the Project Developers / Builders / Real Estate Agents as well as their compliance.
The Site recommends that the Users refer the respective RERA websites, as may be applicable, of the respective State where the Project / Property is registered for complete procedures as well as accurate information related Project / Property posted on the Site by Project Developers / Builders / Real Estate Agents and advises the Users to take all efforts to make necessary verifications before proceeding for finalization / transactions.
In no event the Site is not liable for any damages including, without limitation, indirect or consequential damages, any claims arising due to inaccurate / discrepant information posted on the Site.
The Company makes no representations and warranties of any kind, whether expressed or implied, for the Services and in relation to the accuracy or quality of any information transmitted or obtained at rvaastu.
RENT AGREEMENT DISCLAIMER
"User" or "Tenant" means a company, partnership, proprietorship or any individual person who is searching for a property on rent and is willingly submitting their information and details on Company's portal in connection with the same.
Company is an online portal and acts only as a facilitator between the User/tenant and landlord and does not act as an agent of any of the parties (User and landlord). The transaction between the User and the Company is on principal to principal basis.
All confidential information (including name, e-mail address, etc.) voluntarily revealed by the User is done at the sole discretion and risk of the User. The user authorizes Company and any of its partners / vendors who may facilitate in the process of procurement and creation of the rent agreement to contact him/her via phone, email or Whatsapp. The use of User information is subject to the terms of the Company's Privacy Policy. Users hereby agree that the Company reserves the right to change these terms and conditions at any point of time without notifying the User.
The User in evaluating the appropriate stamp duty for lease deed / rent agreement must seek independent legal advice. The User is responsible for the execution of any lease deed / rent agreement, payment of stamp duty and is obligated to follow the applicable laws of the States in India where the property is situated in connection with the same. Company is not providing any opinion on the applicable laws on the lease deed / rent agreement, and is not under any circumstances, directly or indirectly responsible or liable for the advice and assistance provided by any third party including lawyer and service provider to the User or to the landlord.
Company is not, directly or indirectly, selling stamp papers to any person but is only facilitating the completion of the transaction.
Company has not verified or has given any opinion as to the title of the owner of the property and/or condition of the property and User has to approach the Company only after its own verification and due diligence as to the title of the property and/or condition of the Property.
User and landlord shall be responsible for any tax/duty/liability from any concerned authority related to the transaction between User / tenant and landlord, and the User shall indemnify the Company in case of any liability occurring in consequence of the same.
Company shall not be held responsible and cannot be a Party in case of any dispute between the User/tenant and landlord and the User shall indemnify the Company for any claim / liability on Company in consequence of any such dispute between User and the landlord.
AGENT
Agent can post property but his/her property will only be visible on the portal until it is verified.
Agent can post Requirement but his/her Requirement will only be visible on the portal until it is verified.
Agent will provide the Lead but his/her Lead will only be visible on the portal until it is verified.
USER
Buyer: -Buyer can post Requirement but his/her Requirement will only be visible on the portal until it is verified.
Seller: - Seller can post property but his/her property will only be visible on the portal until it is verified.
BUILDER
Builder can post property but his/her property will only be visible on the portal until it is verified.
Builder can post Requirement but his/her Requirement will only be visible on the portal until it is verified.
CONNECTOR
Connector will provide the Lead but his/her Lead will only be visible on the portal until it is verified.
Connector will post the Requirement but his/her Requirement will only be visible on the portal until it is verified.
Connector will get his payout only when his/her Lead / Requirement are closed after verification.
Connector will be supported by Relationship Manager (RM) to close his/her Lead / Requirement.
COPYRIGHT
The Site shall not be liable for any such information or data which is not within its knowledge / acknowledgment / contraventions / copyright issues committed by its Users and which is beyond the control of verification.
The Site shall have a sole discretion regarding deletion of his User's classifieds/listing/if the same is found to be in contravention of the various copyright right/intellectual property right rights of third party. That the present clause is in compliance with the INFORMATION TECHNOLOGY ACT 2000 and hence no discussion/argument shall be entertained in any case and in any circumstance.
This Agreement applies to each Paid Service (as defined below) in addition to any terms and conditions that may be applicable to such specific Paid Service provided, however, that in the event of any conflict or inconsistency between any provision of the terms and conditions that may be applicable to such Paid Service and any provision of this Agreement, such conflict or inconsistency shall (except as otherwise expressly provided or agreed) be resolved in a manner favorable to Rvaastu.com and/or its affiliates; and only to the extent that such conflict or inconsistency cannot be so resolved, the provisions of the terms and conditions applicable to such specific Paid Service shall prevail.
rvaastu.com may amend this Agreement at any time by posting the amended and restate Agreement on the Site. The amended and restated Agreement shall be effective immediately upon posting. Posting by rvaastu.com of the amended and restated Agreement and your continued use of the Site shall be deemed to be acceptance of the amended terms. This Agreement may not otherwise be modified, except in writing by an authorized officer of rvaastu.com.
OBLIGATION
The Site has no expertise in the domain of intellectual property rights of anyone. It is beyond our scope to verify that the User of the Site have posted ONLY products and services on which they have complete authorization / ownership / dealership / selling rights. As an INTERMEDIARY, our role is limited and in case you have any concern related to copyright infringement then we shall appreciate if the same is to be brought to our notice. The Site neither advocates / endorses such products that may be deemed to be infringing by the virtue of their being did not list on the Site nor does it endorse the infringement by removing such listings.
ELIGIBILITY
The User represents and warrants that he/she is competent and eligible to enter into legally binding agreements and that he/she has the requisite authority to bind himself/herself to these Terms, as determined solely by the provisions of the Indian Contract Act, 1872. The User may not use this Website if he/she is not competent to contract under the Indian Contract Act, 1872, or is disqualified from doing so by any other applicable law, rule or regulation currently in force.
SERVICE
Company provides a number of internet-based services through its platform and shall include:
Posting User profile or listing for the purpose of sale/rental of property, and related property services etc.
Find a property through rvaastu.com and its internet links.
Place a print advertisement in any of the group publications through the www.rvaastu.com site.
Post advertisements on rvaastu.com.
Send advertisements and promotional messages through emails and messages.
The Services can be purchased through various methods of payments offered. The purchase of Services shall be additionally governed by specific policies of sale, like subscription fees, payment policy etc.
HOME LOAN SERVICE
If you express interest for obtaining a home loan & when you authorize us to share the personally identifiable information necessary for our partner Banks to call, email, or SMS you with reference to the home loan interest.
REGISTRATION
We do collect your e-mail address when you register on our forum. However, we do not share your email address with 3rd parties and your email address will never be sold onto any 3rd party. Your e-mail address will be stored in a secure database hosted on a secure website. We only use this address to send you your password to enable you to log into our forums or to send you e-mail notices if you have selected to receive to notification on your profile page. If you complete the profile facility in our forums, it will be viewable by other users, but other than that, we make no use of it. SECURITY
Transactions on the Website are secure and protected. Any information entered by the User when transacting on the Website is encrypted to protect the user against unintentional disclosure to third parties. The User's credit and debit card information is not received, stored by or retained by the Company / Website in any manner. This information is supplied by the User directly to the relevant payment gateway which is authorized to handle the information provided, and is compliant with the regulations and requirements of various banks and institutions and payment franchisees that it is associated with us.
NOTICES
Any and all communication relating to any dispute or grievance experienced by the user may be communicated to the company by the User reducing the same to writing, and sending the same to the registered office of the company by Registered Post Acknowledgement Due / Speed Post Acknowledgement Due ( RPAD / SPAD).
Membership is activated within 2 working days from the receipt of activation charges and is continued for the period for which the activation charges have been submitted, however the Web pages are created as per the information/approval provided by the user and may take some time however no relaxation will be provided/allowed for the said period..
Users be aware that the servers belongs to third party and the continuation to access the services are subject to availability as the same is interrupted at times by technical problems /hackers etc. and rvaastu.com or the parent company is not responsible for the costs/damages/extension of activation period etc. for the same in any manner under any circumstances. The users are advised to spool the messages etc. offline and save them elsewhere in order to avoid any hacking or technical problem.
Membership charges are subject to revision and are at the discretion of the rvaastu.com.
The rvaastu.com reserves their right to block or delete the webpage at any time without assigning any reason etc. and the User's will have no claim or right whatsoever against rvaastu.com under any circumstances.
PG LISTING AND PG PLATFORM
Rasal Associates ("the Company") shall shortly launch new Platform ("PG Platform") w.r.t. PG listings only.
The User is hereby informed that for all the packages bought prior to December 312020; an option shall be made available to convert balance of the existing listing package, in part or full, to be able to advertise on new PG Platform. Any conversion of the existing package to avail new PG Platform services shall be irreversible and cannot be altered.
That the package bought from rvaastu after December 31, 2020 can be used to post regular as well as PG listings on the current rvaastu.com. Platform only till the launch of the new PG platform. In this case, however, if the User has any portion remaining of his/her/its package, User can use it only in the current rvaastu.complatform for listings other than PG. If the User is an agent & deals in PG, the Company recommends, User to buy a separate PG listing package which will be announced shortly.
That all PG listings will be visible on the current platform. However, post launch of PG Platform, these listings would be migrated to the new platform and shall be visible till the expiry duration of the listings.
That the User, who buys a separate PG pack, hereby agrees that in order to improve genuine listings and have authorized Sellers, the Company mandates the agent(s) posting listings against specific PGs to obtain NOC from the PG owners or Operators.
PG owners or Operators shall be required to complete KYC as per rvaastu.com policy.
DECLARATION
GOVERNING LAW AND JURISDICTION
This agreement or any dispute or matter arising from incidental use of rvaastu.com is governed by the laws of India and the User and the Company hereby submit to the exclusive jurisdiction of the Vasai court. This Agreement, accepted upon use of the site and further affirmed by becoming a User of the rvaastu.com, contains the entire agreement between you and rvaastu.com regarding the use of the site and/or the service. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in full force and effect.
Note: Being an Intermediary, the role of rvaastu.com is limited to provide an online platform that is acting in the capacity of a search engine or advertising agency only, for the users to showcase.
